Terms of Service

The legal agreement between you and BookingDumpsters when you use this service.

Welcome to BookingDumpsters. These Terms of Service (“Terms”) govern your access to and use of bookingdumpsters.com and any related services (the “Service”) operated by Haz Tu Marketing (“we,” “us,” “our”). Please read them carefully — by using the Service, you agree to them.

1. Acceptance of terms

By accessing or using BookingDumpsters, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding contract, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. The service

BookingDumpsters is an online marketplace that helps customers in Contra Costa County, California (and other service areas we may add over time) compare and reserve roll-off dumpster rentals from independent local providers (each, a “Provider”).

We facilitate the reservation, payment, and communication between you and the Provider. We do not own, operate, or transport dumpsters ourselves. The Provider you are matched with is solely responsible for the physical delivery, placement, pickup, and disposal of the dumpster and its contents.

Payments are settled through Stripe Connect using a destination-charge model. This means when you book, your payment is routed: the Provider receives their portion for the dumpster service, and we retain our facilitation fee. You see a single charge on your statement; the split happens automatically behind the scenes.

3. Booking & payment

When you reserve a dumpster through the Service, you authorize us to charge your payment method for the total price displayed at checkout, including the dumpster rental, applicable taxes, and any add-ons (extra days, base rock, etc.).

Taxes. Sales tax, use tax, and any other applicable taxes are calculated and collected automatically by our payment processor based on your delivery location and the tax laws of the applicable U.S. state, county, and city. The exact tax shown at checkout reflects the rate in effect at the time of your booking. We do not absorb or pre-pay taxes on your behalf; the amount you see is the amount you authorize.

Payments are processed by Stripe using Stripe Connect (see Section 2). By completing your booking you agree to Stripe’s terms as well. Charges may appear on your statement as “BDUMPSTERS” or similar.

Standard rental is 7 days (heavy materials: 3 days), unless otherwise indicated at checkout. Extra days are billed at the rate shown when adding them; extras require Provider availability and approval.

4. Cancellations & refunds

You can cancel a reservation from your dashboard any time before the dumpster is dispatched. Unpaid bookings cancel at no charge. For paid bookings, a cancellation fee applies to cover logistics already arranged on your behalf, and the remainder of your payment is refunded:

  • 24 hours or more before scheduled delivery: a $25 cancellation fee; the remainder is refunded.
  • Less than 24 hours before scheduled delivery: a $195 cancellation fee, which covers driver dispatch, route planning, and container reservation already committed on your behalf; the remainder is refunded.
  • Once the dumpster is on its way or has been delivered: it can no longer be canceled online and the base rental is non-refundable, though unused add-ons may be refunded at our discretion.

5. Independent providers (Provider liability disclaimer)

BookingDumpsters operates as a technology marketplace — similar to ride-sharing or food-delivery platforms — that connects customers with independent dumpster-rental Providers. Providers are independent contractors, not employees, agents, partners, or representatives of BookingDumpsters or Haz Tu Marketing. We do not own, lease, operate, drive, supervise, train, insure, or otherwise control the Providers or their equipment.

Because Providers operate independently, BookingDumpsters is not responsible for any of the following, and you agree to release us from any claim arising out of them:

  • Property damage caused by Provider trucks, trailers, or dumpsters during delivery, placement, or pickup — including but not limited to driveways, sidewalks, lawns, landscaping, fences, sprinkler systems, septic lines, irrigation, utility lines, public roads, retaining walls, overhead wires, gates, mailboxes, and adjacent property.
  • Bodily injury to any person arising from Provider operations, including injury to the customer, the customer’s family, employees, contractors, neighbors, or bystanders.
  • Provider scheduling issues — delays, missed appointments, early or late arrivals, rescheduling, no-shows.
  • Disputes over accepted materials — each Provider sets its own rules on what can and cannot be placed in the dumpster.
  • Overweight charges, prohibited-item fees, hazardous-material fees, or any other surcharges assessed by the Provider after the fact. These are billed by the Provider directly to you; BookingDumpsters may pass these through but does not absorb or contest them on your behalf.
  • Environmental, regulatory, or municipal violations — fines or penalties assessed by your city, county, state, or any waste-management authority for any reason connected to the dumpster or its contents.
  • Permit requirements — placement of a dumpster on a public street, sidewalk, or right-of-way often requires a permit from your local jurisdiction. Obtaining that permit is your responsibility, not the Provider’s and not ours.

Any claim related to the items above must be addressed directly with the Provider. We will share Provider contact information with you on request and can help facilitate a conversation, but we do not assume liability for Provider acts, omissions, negligence, or willful misconduct.

6. User obligations to the Provider

You also accept obligations directly toward the Provider when you book through the Service. BookingDumpsters acts only as an intermediary; these obligations run between you and the Provider, and we are not responsible for enforcing them or for damages caused by your failure to comply. You agree that:

  • You will not exceed the dumpster’s weight limit. Overweight loads damage equipment and trucks. The Provider may assess overweight fees ($75–$200/ton typical) and you authorize those charges.
  • You will not place prohibited items in the dumpster — including but not limited to tires, refrigerants, freon appliances, paints, oils, batteries, asbestos, medical waste, propane tanks, hazardous chemicals, contaminated soils, animal carcasses, or any item regulated by federal/state/local hazmat law. Specific Provider rules apply; ask before disposing.
  • You will not place anything inside the dumpster that is illegal to dump in your jurisdiction. If you do, you are solely liable for any regulatory fine, criminal penalty, or environmental remediation cost that results.
  • You will provide safe and legal access for the Provider’s truck on delivery and pickup dates. If the truck cannot reach the drop site (blocked driveway, locked gate, low overhead clearance, parked vehicles, no permit on public street), a dry-run fee may apply.
  • You will not move or relocate the dumpster after delivery without Provider authorization. Moving a loaded dumpster can damage your property and is solely at your risk.
  • You are responsible for any damage to the dumpster itself caused by your use (fire, paint, corrosion, impact).

Failure to comply with the above may result in additional charges from the Provider, refusal of pickup, or legal action by the Provider or by public authorities. You authorize us to forward such additional Provider charges to your payment method on file, and you waive any claim against BookingDumpsters for those amounts.

7. Marketplace disclaimer — disputes between User and Provider

Because we operate as a neutral marketplace, any dispute or claim between a User and a Provider — whether arising before, during, or after the rental — must be resolved directly between those two parties. BookingDumpsters is not a party to the underlying rental agreement between you and the Provider, and we do not adjudicate, arbitrate, settle, or assume liability for any such dispute.

This applies in both directions:

  • If you (User) believe the Provider damaged your property, arrived late, charged unfairly, or otherwise harmed you: your remedy is against the Provider, not against BookingDumpsters. We can share Provider contact info and help facilitate communication on request, but we will not refund Provider-side fees, replace property, or compensate you for Provider conduct.
  • If a Provider believes the User exceeded weight limits, placed prohibited items, damaged the dumpster, blocked access, or otherwise caused loss: the Provider’s remedy is against the User directly, not against BookingDumpsters. We may pass through documented additional charges (as authorized in Section 6) but we do not collect, withhold, or guarantee payment of damages owed by the User.

We may, at our sole discretion and as a courtesy, attempt to mediate a resolution. Any such mediation does not create liability for BookingDumpsters and does not waive this disclaimer.

8. Limitation of liability

To the maximum extent permitted by law, BookingDumpsters and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim related to the Service is limited to the amount you paid us for the reservation in question.

The Service is provided on an “as-is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or that any specific Provider will be available at any given time.

9. User conduct

You agree not to:

  • Use the Service for any unlawful purpose or to facilitate illegal disposal of regulated waste.
  • Provide false information when booking.
  • Attempt to interfere with, probe, or disrupt the Service or its infrastructure.
  • Reverse-engineer or scrape the Service for commercial purposes.
  • Impersonate another person or entity.

10. Intellectual property

The Service, including all logos, text, graphics, and code, is owned by Haz Tu Marketing and protected by U.S. and international copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without our written permission, except as needed to use the Service normally.

11. Indemnification

You agree to indemnify, defend, and hold harmless BookingDumpsters, Haz Tu Marketing, our affiliates, officers, employees, agents, and the independent Providers we connect you with, from and against any claim, loss, damage, liability, regulatory fine, or expense (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the Service or breach of these Terms; (b) your violation of any applicable law or third-party right; (c) your placement of prohibited or hazardous materials in any dumpster; (d) any environmental, municipal, or regulatory violation connected to your rental; or (e) any bodily injury or property damage caused by you or your guests, employees, or contractors at the rental site.

12. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from the Service will be resolved in the state or federal courts located in Contra Costa County, California, and you consent to that jurisdiction.

Before filing a claim, please contact us in good faith to attempt an informal resolution.

13. Changes to these terms

We may revise these Terms from time to time. If we make material changes, we will notify you via email or a notice on the site. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
